A Lasting Power of Attorney (LPA) is a legal document that lets you - the ‘donor’ - give someone you trust, the ability to make financial or health decisions on your behalf. No-one likes to consider a time when they cannot make their own decisions but planning for such a possibility is vitally important if you want to influence what will happen.
Lasting Powers of Attorney are valuable documents that give you peace of mind by allowing you to stipulate who is authorised to do what, and in what circumstances, should you find that you can no longer manage your own affairs.
There are two kinds of LPAs:
- money, finances, and property
- health and care
Our team are experienced in advising on, creating and registering both types of LPAs. Whist these are documents that can be completed without the benefit of legal advice, we strongly recommend that advice is nevertheless taken. This is because small distinctions within the drafting of LPAs can seriously limit the effectiveness, and even validity of the entire document.
Additionally, depending on your individual circumstances, your affairs may warrant a series of LPAs, including Business LPAs with one set of attorneys to deal with personal affairs, and different attorneys appointed to manage business interests or other specifically identified assets. We also deal with registration of Enduring Powers of Attorney (EPAS) and the creation of general and specific powers of attorney. Only EPAs made and signed before October 1, 2007, can still be used. After that date donors are required to make a LPA instead.
