When acting for a developer we can provide you with advice about site assembly. That may be a purchase of a property or purchase of one or more properties using option agreements or conditional contracts.
When acquiring the property we would review the title so as to ensure that you had sufficient property for your proposed development. We would consider rights in favour of third parties, such as, rights of way across the property which might prevent development. Are there any restrictive covenants that prevent the use of the property for the intended development? Does your property abut the public highway or do you need rights from third parties that could prevent the development? Are there any ransom strips? Do you have rights to connect to the public water and drainage system and utilities?
We have expertise and can assist you with the following which may be required for your proposed development:
- Development agreement – a document that would identify your obligations to develop the property.
- Building contractor documentation - This is likely to involve amendments to standard JCT contracts, contractor warranties, sub-contractor warranties, parent company guarantees and performance bonds.
- Appointments, warranties and novations for your professional team, which may include architects, engineers, project managers, quantity surveyors/cost consultants etc.
- Advice in relation to statutory agreements that you may need to enter into with the local planning authority, highway authority and water and drainage authority.
We would also help you dispose of your development when completed. That may be to a single owner or tenant or to a number of owners or tenants. We can prepare appropriate disposal documentation. That may be a transfer of a freehold title or long leasehold title or a shorter occupational lease. We will prepare that documentation so as to maximise your return on your development. This may involve setting up a management company and requirements for tenants or occupiers to contribute to common parts of your development.
